user agreement

✦ By commissioning me, you confirm that you have read, understood, and accepted these terms.
✦ I am not responsible if you commission me without reading my Terms of Service.
✦ If you do not agree with any part of these terms, you may not request a commission.
✦ Please read everything carefully. I will decline any commission if you do not agree to these terms.

general

✦ By commissioning me, you are purchasing my services as an Artist only.
✦ I may decline any project or client for any reason.
✦ I retain full ownership of all artwork and may use it for promotion.
✦ You may not associate me or my art with AI or NFT-related content.
✦ You may not profit from my artwork without purchasing commercial rights.
✦ Nothing is ever intended to be physically shipped.
✦ All sales are for Digital Artwork only. You receive a personal-use license unless commercial rights are purchased.
✦ Any dispute will first be addressed through direct communication between the Artist and Client.

client

✦ Clients are expected to read the Terms of Service and understand general pricing before ordering.✦ Clients are not authorized to change, modify, or edit the delivered artwork without the Artist’s permission.
✦ Clients are not authorized to trace, copy, or use the delivered artwork as a base.
✦ Clients may not claim the delivered artwork as their own.
✦ Clients must respect that the Artist’s style cannot be altered.
✦ Clients must respect the Artist’s Do's and Don'ts.✦ Clients may include signatures or watermarks showing the artwork is the Artist’s intellectual property.
✦ Clients may display the delivered artwork on external sites as long as the Artist is credited.
✦ Clients may print physical copies of the delivered artwork for personal use only (not for sale).

copyright

✦ I reserve the right to sign and/or watermark my work.
✦ I do not claim rights to any character design that is not mine. I will not reuse or resell the delivered artwork unless otherwise agreed.
✦ I may share WIPs or completed artworks on any platform unless an NDA is in place.
✦ Clients are responsible for protecting their character design rights when uploading to external sites.

ai usage

✦ The usage of AI on my artwork is strictly prohibited and will result in all licenses being revoked immediately, including personal, monetized, and commercial licenses.✦ The usage of AI includes, but is not limited to:
_{- Altering the delivered artwork with AI (including videos, touchups, animations, etc.).
‣ Feeding the delivered artwork into an AI.
‣ Using the delivered artwork to replicate my style with AI.
‣ Approving or supporting anyone doing any of the above.}✦ If the Terms of Service are violated, a takedown of the delivered artwork will be issued. Legal action may be taken if necessary.

nda & privacy request

✦ Clients must state if their commission should remain private during ordering.
✦ For a legal NDA, contact me. Otherwise, NDA terms are included in the invoice.
✦ NDA fee starts at +10% of the total quote but may vary.
✦ NDA means I cannot share WIPs or artwork until explicit permission is given.

commercial rights

✦ Profile pictures, thumbnails, banners, and social media posts do not count as commercial use.
✦ Some listings may come with commercial rights included (e.g., VTuber models, Twitch panels & badges).✦ Monetized content license

payment

✦ Payment is upfront and accepted through PayPal invoicing only, in € EURO.✦ I will initiate the invoice to prevent accidental payments. Do not send payment until I confirm your commission and request payment via invoice.
✦ I will cover all PayPal fees, as required under PayPal Terms of Service. The price you see is the total amount you will pay.
✦ If your PayPal account malfunctions or a refund occurs without authorization, contact me immediately.
✦ I am not responsible for any errors you make during the transaction.
✦ You may request a price quote before committing.
✦ Payment plans are available for orders over 1,000€, with my approval. Clients must follow the agreed schedule. Late payments may pause, cancel, or incur additional fees.
✦ Tips are not required but always appreciated!

refunds & cancellations

✦ No chargebacks under any circumstances.
✦ No refunds once work has started.
✦ I will issue a full or partial refund (depending on the artwork’s stage) if I am unable to complete your commission for any reason.
✦ Refunds will be issued only through the original payment method.
✦ I reserve the right to cancel an order before payment.
✦ Clients must contact me to cancel a commission request.

timeline & delivery

✦ Clients may set a deadline for their commission, which must be disclosed before payment.
✦ Clients have the right to be notified of any delays.
✦ Clients are responsible for prompt communication; I am not responsible for late delivery due to delayed responses.
✦ I may decline a project if the timeframe is too short.
✦ The average delivery time for illustrations is 1–2 months, depending on current workload and request complexity.
✦ All dates provided are subject to change, and details should be discussed if a deadline was set.
✦ Rush commissions may be accepted to move a project forward, starting at +20% of the total price.✦ Please refer to my waitlist to check current commission progress.

process

✦ After payment, I will start the sketch and send it within 1–3 business days.
✦ I will provide updates at each stage for approval and pause work until I receive a response.
✦ The stages are sketch, lineart, color flats, final artwork.
✦ Additional or different updates can be provided depending on the project or upon request.
✦ If you have specific size requirements, please let me know in advance. I usually work in 4000 × 4000 px, 600 dpi.

revisions & feedback

✦ After the order is completed, minor changes are free if the missing or incorrect elements are my fault (e.g., overlooked details from the order).
✦ Clients may request up to 3 major revisions during the draft phase. Only minor adjustments within reason can be made afterward.
✦ Any additional changes after this may incur a fee, depending on the nature of the change.✦ In the absence of feedback from the client, changes to the final piece will incur a fee.
✦ I am not responsible for unsatisfactory elements if no feedback was provided.
✦ I am not responsible for any changes in ownership of the character.
✦ Clients are responsible for ensuring their order includes all details they want me to follow.

final product

✦ Once the request is completed, the full-size .png image(s) and/or .psd file will be shared via a private Google Drive link or e-mail.
✦ Clients are responsible for saving all files, images, and digital data provided. I will preserve files for up to 6 months, but cannot guarantee against computer failure, accidental deletion, or loss.
✦ Credit to me, Zmeinir, is required when clients post or use the delivered artwork on any platform.
✦ I am not required to post your project publicly, and if posted, I am not required to keep it there indefinitely. I may delete or remove any public project.
✦ I reserve the right to post finished artwork in my gallery or on social media unless an NDA is in place.
✦ Slight differences may exist between gallery samples and the illustration clients receive.
✦ I reserve the right to reject critiques pertaining to artistic skill or stylization if I deem the critique reduces the artistic quality of the piece.
✦ Any rude, inappropriate, inflammatory, or non-constructive comments may result in blacklisting.

how to request

✦ Complete reference materials must be provided from the start.
✦ Specify usage of the VTuber model.
✦ Deadlines are subject to acceptance based on complexity.
✦ Character document must include detailed and comprehensive design. An organized Google Drive folder is appreciated.
✦ Please ensure the budget is secured.
✦ There must be no disputes over the outfit/design and that you hold copyright and commercial rights. Proof may be requested.

revision policy

✦ No additional toggles beyond those in the initial agreement.
✦ Up to 5 additional expressions permitted.
✦ Unlimited revisions during the sketch stage.
✦ Major revisions after the sketch stage will incur an extra fee.
✦ All changes must align with the original commission concept. Changes from the original requested design during after the sketch stage will be declined.

commission process

✦ Project status can be checked anytime via my Trello, updated with every change.
✦ Please do not rush for updates.
✦ Workflow: Sketch → Color draft → Face → Flats → Body base (if applicable) → Hair → Outfit → Toggles/Add-ons (if applicable) → Cutting check → File organizing.
✦ File organizing may be done by a trusted assistant if available.
✦ PSD file delivered within 1–3 weeks after art completion. An unorganized PSD will also be provided for preview.
✦ Face angle references are included for the rigger to maintain stylistic cohesion.
✦ Expression sheets with layer indications are provided to ensure the intended vision is respected.

personal preferences

✦ Not particularly skilled at drawing male characters.
✦ Will not accept overly complex, irregular, or incohesive designs, or designs with excessive colors.
✦ Will not accept overly sexualized characters.
✦ Armor and mech designs are accepted but an additional fee will apply.
✦ Unique and additional hairstyles are appreciated. Traditional Japanese themes and streetwear outfits are my favorites.
